Standard of Care

What would a reasonably prudent practitioner have done in a similar time and place? Failure to meet the Standard of Care is a common assignment for construction-related litigation experts. Did the architect, engineer, general contractor, construction manager, or sub-contractor fail to meet their contractual expectations?

Are the plans and specifications detailed?
– Do the documents complete their intended purpose?
– Is the contract suitable for construction and has its application been executed properly for construction
?

Schedule Delays & Disruptions

Delays and disruptions on a construction project can have detrimental effects and often result in disputes between the owner, contractors, subcontractors, and design professionals. Delays are caused by work starting later than planned or in some cases never commencing at all. Identifying and assessing delay damages is critical to defining responsibility and finding a resolution.

By utilizing critical path method (CPM) techniques and contract analysis, PSC can identify and quantify schedule delays and validate the liability of the damages. These techniques also allow PSC to determine if the delay is excusable, non-excusable, compensable, or non-compensable.

Precision’s delay experts look to identify the type of delay (late start, extended duration, concurrent, pacing, etc.) and determine if a delay is excusable, non-excusable, compensable, and non-compensable. Ultimately, Precision’s experts look to determine the cause and apportion delay to the respective parties.
